These Terms and Conditions include the Privacy Statement which is incorporated into these Terms and Conditions by reference. By using the Website, You are indicating your acceptance to be bound by these Terms and Conditions, including the Privacy Statement.
You must be 18 years of age or older to visit or use the Website in any manner. By visiting the Website or accepting this Agreement, you represent and warrant to TalentPundits that you are 18 years of age or older, and that you have the right, authority, and capacity to use the Website and agree to and abide by this Agreement.
Please read this page carefully. If ‘You’ do not accept the Terms and Conditions stated herein, do not use the Website and its services. By using Website, You are indicating your acceptance to be bound by the provisions of these Terms and Conditions. TalentPundits HR Services Pvt Ltd (“TalentPundits” or the “Company”) may revise these Terms and Conditions at any time by updating this posting. You should visit this page periodically to review the Terms and Conditions, because they are binding on’ You’. The terms “You” and “User” as used herein refer to all individuals and/or entities accessing this Website for any reason.
We offer Employers and Candidates honesty, experience, commitment, and confidentiality. Our TalentPundits Consultants are amongst the most experienced in their fields and maintain high standards of professionalism. We offer an in-depth knowledge of the recruitment market, extensive client contacts, and relationships of trust to help connect Candidates to Employers. As a Candidate, you are certain of the highest levels of confidentiality from us and from our Employer organizations. Our philosophy is to provide integrity, dignity, and respect to both Employers and Candidates. We expect no less of you.
TalentPundits is primarily in the Indian recruitment industry that inter alia provides a set of services that are intended to connect, through the intermediating services of TalentPundits, those individuals who are seeking new employment opportunities (“Candidates”/ “User”) with persons and entities who are looking to hire, retain, or otherwise engage any one or more Candidates from time to time (“Employers”). TalentPundits is NOT a jobsite where Employers directly receive the applications submitted by the Candidate on the Website. TalentPundits, as a search firm, will review profiles and applications submitted by the Candidates, and make considered recommendations to Employers.
The Agreement is published in compliance of, and is governed by the provisions of Indian law, including but not limited to:
- the Indian Contract Act, 1872
- the (Indian) Information Technology Act, 2000, and
- the rules, regulations, guidelines, and clarifications framed thereunder, including the (Indian) Information Technology (Reasonable security practices and procedures and sensitive personal information) Rules, 2011 (the “SPI Rules”) and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).
TalentPundits authorizes the Candidate to view and access the content available on or from the Website solely for the User’s personal use. The contents of the Website such as job postings, information, text, graphics, images, logos, button icons, software code, design, and the collection, arrangement, and assembly of content on the Website (collectively, ” TalentPundits Content“), are the property of TalentPundits and are protected under copyright, trademark and other laws. The User may not modify the TalentPundits Content or reproduce, display, publicly perform, distribute, or otherwise use the TalentPundits Content in any way for any public or commercial purpose or for personal gain.
REGISTRATION AND FEES
In order to access certain features of the Site and Application, and to create a resume to apply to job opportunities, you must register to create an account (“TalentPundits Account”) and become a Member. You may register to join the Services directly via the Site or Application or as described in this section. TalentPundits may, in certain cases, charge fees for registration and certain specific services like resume preparation, counselling, or bespoke consulting. In such cases, the charges would be discussed and agreed upon with the Candidates prior to such services being rendered.
We will create your TalentPundits Account and your TalentPundits Account profile page for your use of the Site and Application based upon the personal information you provide to us. The Candidate can then choose from the various services provided by TalentPundits.
India Sales Jobs will charge fees for registration and certain specific services like resume preparation, counselling, or bespoke consulting. In such cases, the charges would be discussed and agreed upon with the Candidates prior to such services being rendered. These fees are for specific services and may NOT be construed as a commission for finding a job.
CANDIDATE DETAILS AND SUBMISSION
2.1 The Candidate shall be solely responsible for his/her information, resume, content, messages, or other information (“Candidate Details”) that he/she submits, publishes or displays on the Website. By posting such Candidate Details on the Website, the Candidate automatically grants to TalentPundits an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such details and to prepare derivative works of, or incorporate into other works such Candidate Details, and to grant and authorize sublicenses thereof.

Text/Visual Resume Writing
In these services, the candidate will be provided with an MS Word and a PDF copy of a well-documented and formatted Text or Visual resume based on the respective service purchased
- The Candidate shall purchase this particular service
- The Candidate shall submit his/her resume, LinkedIn profile, public URL and other details in a standardized format as in the “Profile Request Form” within ten (10) days of purchasing the service.
- The Candidate shall certify that the information/data supplied by it to TalentPundits is accurate and correct.
- TalentPundits Consultant shall call or email the Candidate to conduct a preliminary discussion.
- In the event necessary inputs required by TalentPundits for commencing the services are not received within 30 days of the date of payment, the order shall stand cancelled and any amounts paid shall be appropriated.
- The Candidate must respond to the queries raised (sent by email) by TalentPundits within 7 days of such a query being raised failing which, TalentPundits shall stand absolved of all its obligation, if any.
- The Registration Fee once paid for by the Candidates is not refundable and all amount(s) paid on behalf of the Candidates shall stand appropriated.
- Based on the mutual discussion, the TalentPundits consultant shall share the first version of the formatted resume with the Candidate within 5 working days of the discussion via email as provided by the Candidate.
- The Candidate can finalize the resume as emailed or request for a revision within five (5) working days from the date of sending the formatted resume. In the event the Candidate does not respond within 5 working days of receiving the formatted resume, it will be assumed that the resume shared is final.
- The Candidate can ask for a maximum of two revisions only.
- The Candidate can request for a second revision within 5 working days of receiving the first revised resume.
- The second revision will be considered as the finalized version.
- Once the candidate finalizes the resume, a PDF and/or a Word document of the resume will be shared with the Candidate via email.
- TalentPundits offers no guarantee nor warranties that there would be a satisfactory response or any response at all once the resume is written and used by the Candidate to apply for jobs.
- TalentPundits shall not be held liable for loss of any data, technical or otherwise, information, particulars supplied by subscriber due to reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond TalentPundits’ reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war, and natural calamities.
- TalentPundits reserves its right to reject any insertion or information/data provided by the Candidate without assigning any reason, but in such an eventuality, any amount so paid for, shall be refunded to the Candidate on a pro-rata basis at the sole discretion of TalentPundits.
- TalentPundits will commence providing services only upon receipt of amount/charges upfront either from Candidate or from a third party on behalf of the subscriber.
- This Service is not transferable.
- The Candidate shall be assigned password(s) by TalentPundits to enable the Candidate to access all the information received through TalentPundits, but the sole responsibility of the safe custody of the password shall be that of the Candidate and TalentPundits shall not be responsible for data loss/theft of data/corruption of data or the wrong usage/misuse of the password and any damage or leak of information and its consequential usage by a third party. TalentPundits undertakes to take all reasonable precautions at its end to ensure that there is no leakage/misuse of the password granted to the subscriber.
- The -User of these services does not claim any copyright or other Intellectual Property Right over the data uploaded by him/her on the Website or provided to Talentpundits through any other channel
LinkedIn Profile
In this service, the candidate will be provided with recommendations for modifying the LinkedIn Profile
- The Candidate shall purchase this particular service
- The Candidate shall submit his/her resume, existing LinkedIn profile public URL, and other details in a standardized format as in the “Profile Request Form” within ten (10) days of purchasing the service.
- The Candidate shall certify that the information/data supplied by it to TalentPundits is accurate and correct.
- TalentPundits Consultant shall call or email the Candidate to conduct a preliminary discussion.
- In the event necessary inputs required by TalentPundits for commencing the services are not received within 30 days of the date of payment, the order shall stand cancelled and any amounts paid shall be appropriated.
- The Candidate must respond to the queries raised (sent by email) by TalentPundits within 7 days of such a query being raised failing which, TalentPundits shall stand absolved of all its obligation if any.
- The Fee once paid for by the Candidates is not refundable and all amount(s) paid on behalf of the Candidates shall stand appropriated.
- Based on the discussion, TalentPundits will share their recommendations and suggestions via email for making specific changes to the LinkedIn profile of the Candidate within 5 days of the discussion.
- If satisfied with the recommendations, Candidates themselves will make changes to his/her LinkedIn profile based on the recommendations and share the updated LinkedIn Public URL with TalentPundits within 5 working days of receiving the recommendations.
- If not satisfied with the recommendations, Candidate can request for a revision within 5 working days of receiving the recommendations. If the Candidate does not respond with the Public URL or request for a change, it will be assumed that the Candidate has accepted the recommendations and does not require any further discussion or revision.
- The Candidate can ask for a maximum of two revisions.
- The Candidate has to finalize or ask for a second revision within 5 working days of receiving the first revision on recommendations.
- The second revision will be considered as the finalized version, in case the candidate doesn’t finalize the earlier versions.
- On receipt of the public URL, TalentPundits may have a final discussion to suggest any further recommendations (if required). This step is optional.
Job Search
TalentPundits shall provide a formatted text resume in an MS Word and PDF format and shall schedule three (3) interviews corresponding to the skill, level, and location of the Candidate. The category and nature of the job shall be decided at the time of initial discussion which shall be conducted with the Candidate within 5 working days of the Candidate choosing the service.

- The Candidate shall submit his/her resume, LinkedIn profile, public URL and other details in a standardized format as in the “Profile Request Form” within ten (10) working days of purchasing the service.
- The Candidate shall certify that the information/data supplied by it to TalentPundits is accurate and correct.
- TalentPundits Consultant shall call or email the Candidate to conduct a preliminary discussion.
- TalentPundits will understand the Candidate’s profile and his/her expectations.
- Text Resume process to be completed as described in 3.1.TalentPundits will identify potential opportunities for the Candidate to apply.
- Based on the Candidate’s inclination, TalentPundits will assist the Candidate in getting a maximum of three (3) job interviews within three (3) months of purchasing the service.
- It is the Candidate’s responsibility to attend the interviews scheduled by TalentPundits.
While TalentPundits will make a bona fide effort to provide the Candidate three (3) fair opportunities, the mandate will be deemed to have been completed if the Candidate gets the job offer with the first /second opportunity provided by us (as long as it is in line with the expectations outlined by the Candidate). For example, the Candidate gives an interview with Employer A, and the Candidate is selected and offered a job, the Candidate will have to proceed with the same offer. The Candidate will not be given additional opportunities to choose from unless the offer is not in line with the expectations outlined during the initial discussion with TalentPundits.
INDEMNITY
You shall indemnify and hold harmless TalentPundits, its owners, licensees, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
DISCLAIMER OF WARRANTIES AND LIABILITY
This Website, all the materials and products (including but not limited to software) and services, included on or otherwise made available to You through this site are provided on “as is” and “as available” basis without any representation or warranties, express or implied, except otherwise specified in writing. Without prejudice to the forgoing paragraph, TalentPundits does not warrant that:
- This Website will be constantly available, or available at all; or
- The information on this Website is complete, true, accurate, or non-misleading.
TalentPundits will not be liable to You in any way or in relation to the Contents of, or use of, or otherwise in connection with, the Website. TalentPundits does not warrant that this site; information, Content, materials, product (including software) or services included on or otherwise made available to You through the Website; their servers; or electronic communication sent from Us are free of viruses or other harmful components.All the contents of this Site are only for general information or use. SERVICE PAYMENT
While availing any of the payment method/s available on the Website, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:
- Lack of authorization for any transaction/s, or
- Exceeding the preset limit mutually agreed by You and between “Bank/s”, or
- Any payment issues arising out of the transaction, or
- Decline of transaction for any other reason/s
All payments made against the purchases/services on Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Website.You have specifically authorized TalentPundits or its service providers to collect, process, facilitate and remit payments and / or the Transaction Price electronically. Your relationship with TalentPundits is on a principal to principal basis and by accepting these Terms of Use you agree that TalentPundits is an independent contractor for all purposes.You understand, accept and agree that the payment facility provided by TalentPundits is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through Cash On Delivery, collection and remittance facility for the Transactions on the TalentPundits Website using the existing authorized banking infrastructure and Credit Card payment gateway networks. Further, by providing Payment Facility, TalentPundits is neither acting as trustees nor acting in a fiduciary capacity with respect to the Transaction or the Transaction Price.TalentPundits reserves the right to impose limits on the number of Transactions or Transaction Price which TalentPundits may receive from on an individual Valid Credit/Debit/ Cash Card / Valid Bank Account/ and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve Bank of India to provide enabling support facility for collection and remittance of payment or by an individual Buyer during any time period, and reserves the right to refuse to process Transactions exceeding such limit.TalentPundits reserves the right to refuse to process Transactions by users with a prior history of questionable charges including without limitation breach of any agreements by user with TalentPundits or breach/violation of any law or any charges imposed by Issuing Bank or breach of any policy.
DISCONTINUATION OR MODIFICATION OF SERVICES
TalentPundits reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter, or modify this service or any part thereof including charges, at its sole discretion at anytime as may be required in view of business exigencies and/or regulatory or statutory changes.
CONFIDENTIALITY
- For the purpose of this Agreement and attachments thereto and all renewals, “Confidential Information” means all financial, commercial, technical, operational, staff, management and other information, data and know-how relating to the Project or to a party (the “Disclosing Party” herein the Company ) or any other members of the Disclosing Party’s group of companies ( including, without limitation, as to products and services, assets, customers, date and database, suppliers or employees), which may be supplied to or may otherwise come into the possession of the other (the “Receiving Party”, herein the User ), whether orally or in writing or in any other form, and which is confidential or proprietary in nature or otherwise expressed by the Disclosing Party or by any of its Associates to be confidential, and not generally available to the public.
- The Receiving Party shall keep confidential and secret and not disclose to any third party the Confidential Information or any part of it, except to any of the Receiving Party’s Associates, if required and upon prior permission in writing from the Disclosing Party. The Receiving Party agrees to take all possible precautions with regard to protecting confidential information from any third party and shall ensure that all its Associates to whom such disclosure is made will act in accordance with the terms of this Agreement as if each of them were a party to this Agreement, and if required obtain a written statement from each of its employees/associates having access to such Proprietary Information undertaking to abide by the confidentiality conditions. All Proprietary Information shall be kept separate and exclusive and at the usual place of business (or residence as the case may be) of the Receiving Party.
- Further no use, reproduction, transformation, or storage of the Proprietary Information shall be made by the User without the prior written permission of the Company, except where required to be disclosed pursuant to any applicable law or legal process issued by any court or the rules of any competent regulatory body.
- On request of the Disclosing Party made at any time, including at the time of termination of this Agreement, the Receiving Party shall deliver back to the Disclosing Party all original documents, records, data and other material in the possession, custody or control of the Receiving Party that bear or incorporate any part of the Proprietary Information. The obligations of confidentiality set out in this Agreement shall continue in force notwithstanding termination of this Agreement for any reason whatsoever.
- All information and data submitted by the User shall become the property of the Company. However all such information shall be kept strictly confidential and the Company shall not, subject to “Violation of Terms & Conditions” clause, release any such data and information to any third party without the prior consent of the User.
- The User has access to only his own data and information stored in the database at TalentPundits (subject to prior confirmation of identity) and nothing more. The User may edit or amend such data and information from time to time.
- All confidential information (including name, e-mail address etc.) voluntarily revealed by the User in chat and bulletin board areas, is done at the sole discretion and risk of the User. If such information, collected by a third party is misused or results in unsolicited messages from such third parties, then such actions are beyond the use beyond the control and liability of TalentPundits and the company accept s no responsibility or liability whatsoever for such actions.
- All copyright and/or know-how and/or any other related intellectual property rights to the Service or TalentPundits shall become and remain the sole and exclusive property of the Company and the User shall have no claims to the same. In the event the User has contributed any content to TalentPundits in any manner whatsoever, all intellectual property rights to the same shall become the absolute property of the Company, and the User shall have no right or claim over the same, in any manner whatsoever. In the event that the User during the term of his Agreement or any time thereafter, uses such intellectual property in any other website or related activity, the same shall be considered as an infringement of the intellectual property rights of the Company and the Company shall have the right to take recourse to whatever legal remedial action is required, in the given facts and circumstances, the costs and peril of which will lie at the end of the User.
- All information of whatsoever nature received from the user is in good faith and is bona fide. The information is believed to be true/ correct and complies with the laws of the land.
- This Agreement and any dispute or matter arising from incidental use of TalentPundits is governed by the laws of India and the Candidate and the Company hereby submit to the exclusive jurisdiction of the courts at Mumbai, India without regard to its conflict of law provisions. Candidate and TalentPundits agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Maharashtra
- Any complaints or concerns with regards to content or to report any abuse of laws or breach of these terms may be taken up with the designated grievance redressal officer as mentioned below via post or by sending an email to connect@talentpundits.com or info@talentpundits.com (“Grievance Redressal Officer”).
